The single most important invention in the history of music is the phonograph. The second most important is the sampler. Before the 1890s, people only experienced live performances, leaving those who didn't sing or play an instrument dependent on finding performers.

The invention of the phonograph shattered these limitations, bringing music into homes and forever transforming our relationship with sound. Less than a century later, advancements in recording technology led to another revolution – the ability to record, manipulate, and playback sound snippets, known as "sampling."

This transformative technique unleashed a creative revolution, defining genres like hip-hop and electronic dance music and impacting the musical landscape, culture, and even law.

The Early Roots of Sampling

In 1977, New York City was going through an economic downturn. Budget cuts to public schools limited access to musical instruments, leaving aspiring musicians and producers with few resources.

On July 13, 1977, amid an exhausting heatwave and after the shock of a serial killer spree, lightning took out three electrical substations on the Hudson River, sending most of the city into a blackout that lasted 25 hours that saw over 1,600 retail stores looted.

After the darkness of that blackout, New Yorkers sparked a creative flame – samplers, turntables, speakers, and drum machines found their way into black hands for the first time, giving birth to hip-hop.

Before Sampling: The Rise of Breakbeats

In the early days of hip-hop, DJs showcased their skills by manipulating funk records. They extended drum breakdowns by "juggling" two copies of the same record to keep the beats going for the dancefloor.

Later, purpose-built battle records with looped drum breaks helped DJs create more interesting and varied beats for dance parties. The introduction of samplers changed everything. DJs and producers could record and play drum beats (and anything else), breaking free from the limitations of turntables.

It opened a new world of possibilities, enabling artists to explore new sonic landscapes. Sampling became a transformative force in hip-hop and electronic music production.

In 1981, Brian Eno and David Byrne's visionary collaboration, "My Life in the Bush of Ghosts," mesmerized listeners with its innovative use of sampling.

The album was the first to feature samples as a lead vocalist, seamlessly blending found sounds, vocal snippets, and drum loops – things we take for granted today but were unheard of in its time.

To celebrate the album's influence on music culture, the 2006 reissue made the multi-tracks of two of the songs available to download and remix under a Creative Commons license.

During the late '80s and early '90s, sampling reached its apex in the Golden Age of Hip-Hop. The simple process of clearing samples in the 80s made Paul's Boutique possible – the clearance process would be much more expensive today, putting it out of reach for anyone without deep pockets; Mike Simpson, one of the Dust Brothers, co-producers of Paul's Boutique said there are between 100 and 300 samples on the album.

The Amen Break: The Seven-Second Sample that Spawned Entire Genres

No discussion of sampling would be complete without mentioning the world's most well-known drum break: the "Amen Break," sampled from seven seconds from "Amen, Brother," an obscure B-side of a Grammy-winning record the soul group The Winstons recorded in 1969.

This break was largely overlooked until 1986 when Street Beat Records published the original Ultimate Breaks and Beats battle record, including the Amen Break as the last track on side A. Salt N' Pepa used the beat on their record I Desire that same year, but the explosive popularity of NWA's Straight Outta Compton two years later made the Amen Break world famous.

Since then, this break has been sampled thousands of times and used in every conceivable manner, from a simple loop played at its original tempo, sped up to suit the faster tempos common to drum and bass, and chopped and rearranged into every permutation imaginable in genres like ragga jungle and breakcore.

Nate Harrison's brilliant 2004 mini-documentary is a must-watch for the depth of its exploration into the nature of culture and copyright, art and creativity, and the history of the most famous sample in the world.

Redefining Possibilities: Endtroducing…

In 1996, DJ Shadow shattered the mold with his groundbreaking album "Endtroducing," the first to be entirely composed of samples. DJ Shadow composed the entire album by recording vinyl records into an Akai MPC60, a groundbreaking instrument that led to a groundbreaking album.

With its meticulous sampling craftsmanship and atmospheric soundscapes, DJ Shadow crafted a flawless artifact that showcased the sheer potential of sampling as a solo instrument.

Sampling and Copyright: Shaping International Law

In the world of sampling, legal battles have shaped the music landscape and copyright law. One significant case occurred in 1989 when The Turtles sued De La Soul for using an uncleared sample on their album 3 Feet High and Rising.

This case set a legal precedent, dampening sampling in hip-hop. Another landmark case in 1991 involved Gilbert O'Sullivan suing Biz Markie for sampling "Alone Again (Naturally)."

The ruling stated that sampling without permission infringed copyright, leading to the album's recall until the song could be removed.

Whether minimal or trivial sampling should be allowed has faced legal scrutiny. In 2000, a court ruled that the Beastie Boys' minimal sampling of James Newton's composition did not require clearance.

However, in a 2005 case where a company that owned the rights to some Funkadelic records sued NWA over extremely short samples, the judge ruled they were licensable. Fourteen years later, the European Court of Justice ruled that recognizable samples require permission.

These legal battles and judgments have significantly impacted sampling practices.

If a producer wanted to avoid potential lawsuits down the road, there were generally two options: sample obscure sources or pay hefty fees to "clear" samples, getting permission from the rights owners, typically too costly for emerging and independent artists.

Some argue that these restrictions stifle creativity, while others view them as incentives for innovation.
